Terms of Service

1. Agreement to Terms

By accessing or using Klamaru ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

2. Description of Service

Klamaru is an operations and analytics platform for multichannel sellers. The Service provides:

• Order management and processing
• Listing analytics and performance tracking
• Stock forecasting and inventory management
• Customer service automation
• Sales analytics and reporting
• Integration with marketplace APIs (Amazon SP-API, eBay API, Allegro, Shopify, WooCommerce)

3. User Accounts

To use the Service, you must:

• Create an account with accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

4. Marketplace Integrations

When connecting marketplace accounts (Amazon, eBay, Allegro, Shopify, WooCommerce):

• You authorize Klamaru to access your marketplace data via official APIs
• You must comply with the terms of service of each marketplace
• You are responsible for maintaining valid API credentials
• Klamaru complies with marketplace Acceptable Use Policies, including Amazon AUP 4.6

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Violate any marketplace terms of service
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Use automated systems to access the Service without permission
• Share your account credentials with unauthorized parties

6. AI and MCP Access

The Service can expose your account to an AI agent through an MCP server. This is disabled by default and is enabled per company by an administrator at one of three levels: disabled, read only, or read and write. API keys are issued per company and can be revoked at any time. You remain responsible for actions taken through keys issued on your account, including actions initiated by an AI agent you have authorized.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy and Data Protection Policy. By using the Service, you consent to the collection and use of information as described in those documents.

8. Fees and Billing

Paid plans are billed in advance, monthly or annually, in GBP and excluding VAT. Usage above a plan limit is invoiced as an overage at the published rate rather than blocking access to the Service. Fees already paid are non-refundable except where required by law.

9. Intellectual Property

The Service and its original content, features, and functionality are owned by Klamaru and are protected by international copyright, trademark, and other intellectual property laws. Data you or your connected marketplaces put into the Service remains yours.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or unforeseen circumstances. Marketplace and carrier integrations depend on third-party APIs that may change or fail independently of us.

11. Limitation of Liability

To the maximum extent permitted by law, Klamaru shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may close your account at any time and export your data before doing so.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.
